Large network of agencies

People are confused by the large network of agencies involved in the process. The regulation of cannabis operations is primarily handled by the Bureau of Cannabis Control (BCC), the California Department of Food and Agriculture (CDFA), and the California Department of Public Health (CDPH). The State Water Resources Control Board and the California Department of Fish and Wildlife (CDFW) also have roles to play. All five of these agencies have issued a unique set of rules business owners and operators must follow.

On top of all that, many of California’s cities and counties have their own cannabis control measures in place. Many of those that have not issued their own rules are in the process of developing them.

It’s also helpful to understand the scope of each agency and what it is they regulate.

  • The BCC’s regulations cover retailer operations; security at all facilities handling or processing cannabis; advertising rules; employee attire and conduct procedures; and a bevy of other compliance matters.
  • The CDPH oversees the production of cannabis-infused products and related goods.
  • The CDFA prescribes numerous rules pertaining to cannabis cultivation.

In addition, the State Water Resources Control Board created another set of regulations cultivators must follow. And if a cultivator diverts water or alters stream beds to irrigate their grows, they need to make sure they sign and follow the CDFW’s so-called “General Agreement.”
